Terms of Service & End User License Agreement

These Terms of Service and End User License Agreement (the "Terms") are a binding agreement between you and Astrolab ("Astrolab", "we", "us", or "our"), the provider of the Flik mobile application ("Flik" or the "App"). By creating an account or using Flik, you agree to these Terms. If you do not agree, do not use Flik.

1. Who can use Flik

You must be at least 13 years old to use Flik (or older if the laws of your country require it). By using Flik you confirm that you meet this requirement and that the information you provide is accurate. Flik is intended for sharing photos within a small, private group of people you personally know — not for broadcasting to the public.

2. Your account

You can sign in with Google, Sign in with Apple, or an email address and password. You are responsible for keeping your login credentials secure and for all activity that happens under your account. Tell us promptly if you believe your account has been used without your permission.

3. License to use Flik

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to download and use Flik on a device you own or control, for your own personal, non-commercial use. Flik is licensed, not sold, to you. We and our licensors retain all rights, title, and interest in and to Flik, including all intellectual property rights.

4. Your content

"Your Content" means the photos, notes, display name, handle, and anything else you create or upload in Flik. You keep ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and display Your Content solely to operate and provide Flik to you and the friends you choose to share with. This license ends when you delete Your Content or your account, except for copies that are already in routine backups or that we must keep to comply with the law.

You are solely responsible for Your Content and confirm that you have the right to share it and that it does not violate these Terms or anyone else's rights.

5. Zero-tolerance policy for objectionable content and abuse

Flik does not tolerate objectionable content or abusive users. You agree not to create, upload, send, or share any content, and not to engage in any conduct, that:

• is sexually explicit or pornographic, or contains nudity of a sexual nature;
• sexualizes, exploits, endangers, or otherwise harms minors in any way (we report child sexual abuse material to the appropriate authorities and permanently ban the accounts involved);
• harasses, bullies, threatens, intimidates, stalks, or defames another person;
• promotes hatred or violence against people based on race, ethnicity, national origin, religion, disability, gender, age, sexual orientation, or gender identity;
• depicts graphic, gratuitous, or real-world violence, gore, or cruelty;
• promotes self-harm, suicide, or dangerous or illegal acts;
• is illegal, infringes someone's intellectual property or privacy, or violates any applicable law;
• impersonates another person or misrepresents your identity or affiliation;
• is spam, or is intended to deceive, scam, or defraud.

6. Reporting and blocking

Flik gives you tools to keep your space safe, and you agree to use them rather than retaliate:

• Report a photo. Open any photo and tap the action button to report it. The photo is removed from your wall immediately, and the report is sent to us for review.
• Block a user. From a friend's row in your profile, tap Block. A blocked person is removed from your shared wall and cannot add you back. You can review and undo your blocks at any time in Profile → Blocked users.

We review reports and take action on objectionable content and abusive accounts, typically within 24 hours. By using Flik you acknowledge and accept this zero-tolerance approach to moderation.

7. Things you must not do

In addition to Section 5, you agree not to:

• copy, modify, reverse engineer, decompile, or attempt to extract the source code of Flik, except where the law expressly permits it;
• use bots, scrapers, or other automated means to access or collect data from Flik;
• interfere with, disrupt, overload, or attempt to gain unauthorized access to Flik or its systems;
• resell, sublicense, or commercially exploit Flik or any part of it;
• use Flik to violate the rights of others or any applicable law.

8. Suspension and termination

We may suspend or terminate your access to Flik at any time, with or without notice, if you violate these Terms or if we reasonably believe it is necessary to protect other users, Flik, or the public. You may stop using Flik and delete your account at any time from within the App (Profile → Delete Account); doing so permanently erases your account and Your Content as described in our Privacy Policy.

9. Privacy

Your use of Flik is also governed by our Privacy Policy, which explains what we collect, how we use it, and how you can delete your data. Please read it.

10. Disclaimers

Flik is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Flik will be uninterrupted, secure, or error-free, or that photos will always develop or be delivered. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

11. Limitation of liability

To the maximum extent permitted by law, Astrolab and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, goodwill, or profits, arising from or related to your use of (or inability to use) Flik. To the maximum extent permitted by law, our total liability for any claim relating to Flik will not exceed the greater of the amount you paid us to use Flik in the 12 months before the claim (which is typically zero) or USD 50.

12. Indemnification

You agree to indemnify and hold harmless Astrolab from any claims, damages, or expenses (including reasonable legal fees) arising out of Your Content, your use of Flik, or your violation of these Terms or of any law or the rights of a third party.

13. Changes to Flik and to these Terms

We may update Flik and may change these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the App. Your continued use of Flik after the changes take effect means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of Vietnam, without regard to its conflict-of-laws rules, except where mandatory consumer-protection laws of your country of residence apply.

15. Apple App Store — additional terms

The following applies if you download Flik from the Apple App Store. You acknowledge that these Terms are between you and Astrolab only, and not with Apple Inc. ("Apple"), and that Apple is not responsible for Flik or its content.

• Apple has no obligation to provide any maintenance or support for Flik.
• If Flik fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Flik.
• Apple is not responsible for addressing any claims by you or a third party relating to Flik, including product-liability, regulatory, or consumer-protection claims, or any claim that Flik infringes intellectual property rights.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and that you are not on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
